| 一、 | 依據113年12月20日府財務字第1130359029號函暨行政院113年12月17日院臺財字第1135025290B號函辦理。 |
| 二、 | 旨揭條文修正重點如下： |
| (一) | 配合營業稅法第二條之一有關銷售電子勞務規定之用語，酌修文字。 (修正條文第四條之一) |
| (二) | 配合營業稅法第六條之一有關「加工出口區」及「科學工業園區」用語及其設置依據之法律名稱，酌修文字。(修正條文第七條) |
| (三) | 修正委由快遞業者出口高價貨物應以一般出口報單辦理通關之法令依據為空運快遞貨物通關辦法及海運快遞貨物通關辦法。(修正條文第十一條) |
| (四) | 為減輕營業人依從成本，刪除免稅商店應檢附其核准設置文件向主管稽徵機關申請登記規定。(修正條文第十二條) |
| (五) | 營業稅法第八條第一項第十九款前段所稱飼料，回歸飼料管理法第三條規定。(修正條文第十六條之三) |
| (六) | 營業稅法第九條第三款所稱古物，回歸文化資產保存法第三條第一款第八目規定。(修正條文第十七條) |
| (七) | 外國事業、機關、團體、組織在我國境內無固定營業場所，銷售電子勞務予境內自然人之銷售額非以臺灣銀行牌告外幣計價者，應轉換為新臺幣銷售額之折算方式。(修正條文第三十二條之二) |
| (八) | 配合本細則第十一條之一有關營業人經由在我國境內無固定營業場所之外國事業、機關、團體、組織，銷售電子勞務予境外自然人適用零稅率證明文件規定，修正依營業稅法第三十五條規定申報銷售額、 應納或溢付營業稅額應檢附之文件。(修正條文第三十八條) |
