| 主旨： | 函轉有關教育部國民及學前教育署委託國立陽明交通大學發展之「學生嚼檳建議處遇流程流程」1份，請貴校落實校園檳榔危害防制作為，詳如說明，請查照。 |
| 說明： |
| 一、 | 依據教育部國民及學前教育署113年12月26日臺教國署學字第1130146027號函辦理。 |
| 二、 | 依學校衛生法第 24 條規定，高級中等以下學校，應全面禁菸；並不得供售菸、酒、檳榔及其他有害身心健康之物質；兒童及少年福利與權益保障法第43條、第91條規定，兒童及少年不得吸菸、飲酒、嚼檳榔。任何人均不得販賣、交付或供應第43條第1項第1款至第3款之物質、物品予兒童及少年。販賣、交付或供應酒或檳榔予兒童及少年者，處新臺幣1萬元以上10萬元以下罰鍰。 |
| 三、 | 為建立無檳校園，落實學校檳榔危害防制教育，倘學校查獲學生攜帶或嚼食檳榔，請依兒童及少年福利與權益保障法施行細則第11條第1項規定予以勸導制止，並酌情通知兒童及少年之父母、監護人或實際照顧之人加強管教；如知悉出處或販售來源，請通報當地社會局(處)或警察單位查處。 |
| 四、 | 請貴校持續推動落實檳榔危害防制工作，強化嚼檳個案追溯調查機制及拒檳輔導措施，有關「拒檳素養學習錦囊」電子書(網址:https://nosmokingedu.blogspot.com/search/label/%E6%8B%92%E6%AA%B3-%E7%B4%A0%E9%A4%8A%E9%A1%8C%E5%BA%AB)請多加參考及宣導，共同推行檳榔防制工作。 |
